Dodgers, Diamondbacks Trade Hits Snag

"... When the Diamondbacks sent starter Jon Garland to the Dodgers late last month, they expected to receive infielder Tony Abreu in return. In addition to his gaudy minor league stats, Abreu appealed to Arizona because he still had two more pre-arbitration years ahead of him and five years total before he became a free agent.
However, as Nick Piecoro of The Arizona Republic reports, the team had no way of knowing that Abreu and the Dodgers were close to reaching an agreement to settle a grievance filed in 2007. As a result of the settlement, Abreu will be awarded additional service time that will make him arbitration eligible in 2011 instead of 2012. The D-Backs believe LA did not act in good faith during negotiations."

Dodgers General Manager Ned Colletti and Assistant General Manager Kim Ng declined to comment on the situation, but sources said the Dodgers aren’t planning to offer the Diamondbacks any money to offset Abreu’s pay increase or add any players to the list of players they can select.

Bah, wasn’t the grievance for Abreu when he went down on an injury and the front office sent him down to AAA instead of placing him on the major league DL first (thus denying him service time)? (very vague memory here)
If so, then that’s pretty public info that should have been looked up first… no shame on LA here…
There's a difference
between knowing that a grievance was filed and knowing that the Dodgers were about to settle it by granting him extra time.

They knew of the grievance. Its up to the Diamondbacks in their due diligence to ask “hey, what is the status of that grievance, anyway?”
If they did that, and the Dodgers lied to them, they have a case. I doubt that is the case.
