Dodgers Look For Series Win Against Phillies
Today's series finale features quite a pitcher's duel at Dodger Stadium, with Clayton Kershaw battling Roy Oswalt. The two just missed each other last month in Philadelphia, with Oswalt throwing seven scoreless innings on August 11, and Kershaw allowing two runs in his 6 2/3 innings one day later. It's best not to remember what happened after Kershaw left that game.
The Dodgers are 5-3 at home this season in the rubber game of a three-game series.

Trading for Oswalt would have been such a disaster
He wouldn’t have given much more than Lilly has, and the Dodgers would have been fleeced in that deal. As many of us said at the time, the huge Dodger hole was hitting not pitching.
Considering what the Phillies gave up for him and the low amount they are paying Oswalt, and they have him for 2011, I would have loved to trade for Oswalt.

I have mixed feelings, I know a lot of people want new ownership but I’d rather just see it resolved. I think it can be stable under McCourt and could be really terrible off season if they need to find a new owner (in addition to manager).

If he ends up getting control of the team, given how leveraged he is and how much he will owe Jamie, he won’t have the money to build a team. Apparently he is not a great candidate for partners either. I am for lancing the wound now. Am rooting for Cuban

I mean, if the Dodgers are excluded from Frank’s personal assets, then they are community property, in which case the team will have to be sold, in which case no more McCourts.
That IMO is the best outcome, even if it hinders the team for a year or two. We don’t have a strong likelihood of being competitive next year anyways.

Ned has given 3 plus year deals to.
Furcal (twice), Blake, Schmidt, Pierre and Kuroda. Nomar got what turned out to be 3 years.
But he has given far more two and single year deals.
If the money was right, I would be okay with 3 years to Lilly.

Theriot and Carroll sure had a hell of a month for the Dodgers in August. Carroll had a .419 OBP and Theriot had a .378 OBP I believe. I hated the Lilly deal at first, but both Lilly and Theriot are making it look much, much better. Now if only Dotel didn’t suck ass.

Lilly has nothing to do with it. The team will finish out of the playoffs, so the time you got of Lilly is meaningless. You don’t trade a player (DeWitt) so you get the first oppurtunity to negotiate with a pending 34 year old free agent.

I think trading for Lilly is what gives us the bridge to signing him in the off-season (i know I know, the Blake-Santana mess all over again). The logic makes no sense, but that’s how GMs are for whatever reason.

I’m guessing it’s because you trade for players you’d like to have on your team, so you are more willing to pay them rather than GMs being dumb and not knowing who the free agents are.

McCourt Divorce
The 2004 agreement (with its corrections and what not) was set up to protect family assets in event of creditor problems. There was no pre-nuptual nor a post-nuptual agreement in the event of a divorce (as far as I know).
Now, at the time of divorce, the assets are very different in value and the proposed split of assets(or NET assets) is nowhere near 50/50%. This is a comm prop state. It seems to me that Frank is trying to make the creditor protection deal into a sort of post-nuptual, assuming the changes post-signature don’t invalidate the aggreement. That seems like a big stretch.
And how does Jamie’s title as President and corresponding salary for all of these years jive with the concept that she voluntarily relinqueshed all claims to the Dodgers.

I really believe that
they will work out a settlement where he keeps the team, Jamie gets a large percentage that Frank will try to sell down the road, she gets some spending money from selling off some of their real estate holdings.
In other words, I still think the odds
of Frank still owning the team when this is done, is pretty good.
If frank gets the team before next season
I bet he tries to spend a ton of money to bring in players to try to repair his image.

I have never been that optimistic
that this TV money will actually amount to more than what they get now.
Of course it is all about the money. Every sports owner is. So say they do have to sell the team? Where are all of these local billionaires who would step up and buy them. All of the usual suspects are just blowing smoke. Frank still the best option.

I think its too late to settle. How would they agree on a percentage? especially now that its at trial.
Divorce is meant to evenly split the assets unless a post-nuptual exists. And Jamie will rightly argue that in her executive position she contributed to the increased value of the franchise.
And whose name is on the loans? Just Frank? if so, he needs to maintain a certain amount of assets behind those loans. Could they give her a percentage of the equity AND the debt? Would she even agree to that?
The logical ruling here is that Jamie is entitled to her share of the assets unless a post-nuptual says she has no claim. And since they are so leveraged with little equity, the biggest asset should be sold. IMO

This really is a method to divide control in a business asset. And since she has apparently made overtures about ways to get a settlement where she could share in future proceeds of the team, I think it could be reached.

but I don’t think Jamie can have it both ways. This may be a community property state, but the marriage can agree to separate ppty. I thought the 2004 agmt (allegedly) separated what would’ve been comm pty, giving Jamie the houses and Frank the team. People can and do separate property w/o divorce in mind, like if they have kids from another marriage and what those kids to get the ppty. If she signed away her rights to the team, for whatever reason (unless fraud), she signed them away. Doesn’t matter if it was to protect them from creditors. Creditor liability and debt is really what drives a lot of these commty ppty laws.
I actually think her role as president and salary supports a finding that she gave up her claims to team ownership. She gave up the rights to the team, in return she gets (1) real estate property, (2) to be president & $$$ (for doing…?)
